ACLU sues to get illegal immigrants counted in Congressional apportionment. This is nuts.

MCALLEN, TX – On Friday, the ACLU filed a lawsuit against the Trump administration on behalf of a number of open borders lobbying groups — including New York Immigration Coalition, Make the Road New York, CASA, American-Arab Anti-Discrimination Committee, ADC Research Institute, and FIEL Houston, demanding that illegal aliens be counted in congressional apportionment.

The Trump administration signed a memorandum excluding illegal aliens from being counted when the federal government apportions congressional representation to the states. This reverses existing policy that allows states with large illegal populations to have more congressional representation by counting all residents rather than just legal residents.

The ACLU lawsuit claims that eliminating those here illegally from being counted for congressional apportionment is unconstitutional.

The lawsuit filed in U.S. District Court in the Southern District of New York states:

“The new policy of excluding undocumented immigrants from the Census conveys a xenophobic message aimed at suppressing Census participation from households containing immigrants and non-citizens.

“Unless enjoined, the policy undoubtedly will undermine the effectiveness of the Census Bureau’s operations and deter members of immigrant communities — including undocumented immigrants, non-citizen immigrants with legal status, and United States citizens — from participating in the Census.”

White House officials have said federal law gives the president authority to determine “the whole number of persons in each state,” which informs the allocation of congressional representatives to each state. The memorandum ensures states with small illegal alien populations are not rewarded less representation in Congress than states with large illegal alien populations.

Supporters of the lawsuit are citing section 2 of the 14th Amendment which says:

“Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed.

“But when the right to vote at any election for the choice of electors for President and Vice President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.”

They are keying in on the phrase, “whole number” saying that there is no indications of immigration status mentioned.

Since this section also states “in any way abridged, except for participation in rebellion, or other crime,” it bears asking if the “protesters” in Seattle, Portland, New York, etc… should be counted or should be eliminated under the “rebellion crime.”

Federation for American Immigration Reform (FAIR) President Dan Stein praised Trump’s decision, and said for too long American citizens and legal immigrants have been “denied representation” in Congress because of the “inclusion of illegal aliens” in congressional apportionment.

Stein continued:

“The practice has also robbed Americans in some states of federal resources and awarded federal dollars to states with large populations of illegal aliens. Often, the states that gain representation and federal resources encourage illegal immigration through sanctuary policies and generous benefits to illegal aliens.”

Stein said:

“The process of including illegal aliens in the Census count for the purpose of reapportionment, as it has been practiced in recent decades, is fundamentally unfair to law-abiding Americans, and the president should be applauded for taking long-overdue action to safeguard their interests and constitutional rights.”

Here’s more on illegal immigration in the US.

According to the Pew Research Center, a nonpartisan think tank based out of Washington, DC, in 2017, there were 11.6 million immigrants from Mexico living in the United States and almost half of them were illegal. 

At a Laredo, Texas immigration checkpoint along U.S Highway 83, Border Patrol Agents disrupted a human smuggling attempt in South Texas on July 13.  Agents spotted the white semi-tractor-trailer approaching them for inspection. 

When initially interviewed, both the driver and the passenger, who were American Citizens, admitted to having people locked inside the trailer. 

When the agents opened the rear of the semi, there were approximately 35 illegal immigrants attempting to make entry into the United States. 

The temperature in the back of the truck at the time the Agents discovered the illegal immigrants was 126 degrees Fahrenheit.  Agents noted that there was no way for the people locked in the back of the trailer to be able to escape in the event of a crash or abandonment by the human smugglers. 

Both the driver and the passenger were arrested and placed into custody of the U.S. Immigration and Customs Enforcement Homeland and Security Investigations.

Earlier in July, agents intercepted another group of illegal immigrants attempting to enter the United States locked inside a tractor-trailer.  Agents identified these 66 illegal immigrants as originating from Brazil, El Salvador, Guatemala, Honduras, and Mexico.

Officials at the Laredo Sector Immigration Checkpoint report an increase in the number if illegal immigrants being smuggled inside tractor-trailers into the United States in recent months. 

With the increase in illegal immigrants, comes an increase in infectious diseases.  With so many people choosing to not vaccinate against diseases, illegal immigrants are helping to spread diseases such as mumps, measles or tuberculosis into the United States.

This is therefore creating an influx of large outbreaks in a population that had pretty much irradiated these diseases in the past.  

With the greater influx of these diseases, comes a huge surge in the cost of medal care for those that are housed at these holding facilities, and taxpayers are left footing the bill.

In fiscal year 2018, the Yuma sector of Border Patrol reported more than $700,000 in medical care for approximately 1,700 illegal immigrants who had been apprehended at their checkpoint and had to be transported to a local hospital. 

Many of these migrants, mostly children, arrive to these facilities suffering from illnesses not seen in America today.

A Reuters article from March 10, 2019, spoke in detail about the large numbers of illegal immigrants who had to quarantine because of exposure to diseases that are preventable by a simple vaccine. 

In this article, it stated:

“Ice health officials have been notified of 236 confirmed or probable cases of mumps among detainees in 51 facilities in the past 12 months, compared to no cases detected between January 2016 and February 2018.  Last year, 423 detainees were determined to have influenza and 461 were determined to have chicken pox. All three diseases are largely preventable by a vaccine.” 

Despite an on-going, world-wide COVID-19 Pandemic, human smugglers continue to put the lives of American Citizens in danger as well as the immigrants they exploit by bringing them into the country with no concern for health or safety measures.
